Rental Agreement for E-Chopper/E-Bike
Section 1: General Terms and Conditions
Article 1: Receipt and Return of E-Chopper/E-Bike
The renter acknowledges receiving the E-Chopper/E-Bike in good condition. Upon receipt, the renter will receive instructions on its operation and is expected to return the E-Chopper/E-Bike in the same condition.
Article 2: Age and Identification
The renter of the E-Chopper/E-Bike must be at least 16 years old and provide valid identification with a driver’s license or valid moped certificate. The E-Choppers/E-Bikes are suitable for a maximum of one person. The renter declares compliance with the specified conditions.
Section 2: Safety and Legislation
Article 3: Legislation and Behavior
The renter must comply with Dutch legislation at all times during the rental period (including helmet requirements) and remain within Dutch territory. It is prohibited to use alcohol, drugs, or medications (that may affect driving ability) before or during the ride.
Article 4: Safety Equipment
The renter must wear the safety equipment provided by the lessor, including a helmet, at all times during the use of the E-Chopper/E-Bike.
Section 3: Payment and Insurance
Article 5: Payment and Deposit
The renter must pay the total amount of the agreement in advance. No deposit is required.
Article 6: Liability and Insurance
Third-party liability for the E-Chopper is covered by insurance. The deductible in case of damage is €1,375. For the E-Bike, it is €950.
Section 4: Damage and Violations
Article 7: Damage to the E-Chopper/E-Bike
The renter is liable for any damage to the rented E-Chopper/E-Bike, regardless of whether the damage results from their own fault or that of third parties. The renter must reimburse the lessor for repair costs, including damaged parts.
Article 8: Parking Policy
When parking, the renter must remove the keys from the E-Chopper/E-Bike’s ignition. Additionally, the renter must ensure that the vehicle remains in sight and assumes responsibility for theft or loss.
Section 5: Terms of Use
Article 9: Subleasing
The renter and co-renters are not allowed to sublease the E-Chopper/E-Bike to third parties or transfer rental rights wholly or partially to others.
Article 10: Distance Limitation
The maximum distance that can be covered with the E-Chopper/E-Bike is 55 km. The renter must adhere to this limit. If the battery runs out due to exceeding the maximum distance, pickup costs will apply.
Article 11: Return and Late Return
No refund (full or partial) will be given for early returns of the E-Chopper/E-Bike. Unauthorized and/or late returns will incur a fee of €12.50 per half hour, payable immediately.
Article 12: Responsible Management
The renter must handle the rented E-Chopper/E-Bike as a responsible manager and use it for its intended purpose. The lessor reserves the right to repossess the rented E-Chopper/E-Bike without refund in case of suspected misuse.
Section 6: Cancellation, Modification, and Maintenance
Article 13: Cancellation
The renter can cancel the reservation free of charge up to 14 days before the start date of the rental.
Article 14: Reservation Modification
The renter can make free modifications to the reservation up to 48 hours before the rental period begins. This includes changes in date, time, or type of E-Chopper/E-Bike.
Article 15: Maintenance
The E-Chopper/E-Bike is well-maintained and offered to the renter in good condition. The renter agrees to maintain the E-Chopper/E-Bike and will promptly report any damage resulting from negligent maintenance to the lessor.
